Website Terms and Conditions of Sale – Nordhaus Craft

1. Business identity, scope and acceptance

The website nordhauscraft.com (the “Site”) is operated by Michael Sharvit, Israeli licensed dealer no. 200657260, trading as Nordhaus Craft, of 18/4 Eucalyptus St., Ofakim, Israel (“Nordhaus”, “we”, “us” or “our”).

These Terms govern browsing, purchases, reviews, enquiries and every other use of the Site. By using the Site or placing an order, you confirm that you have read and accepted these Terms and the Privacy Policy. If you do not agree, do not use the Site or place an order.

Mandatory law, including non-waivable consumer rights, prevails over any conflicting provision. Nothing in these Terms excludes a right that cannot lawfully be excluded.

2. Consumers, Business Customers and Personalised Orders

A “Consumer” buys mainly for personal, family or household use. A “Business Customer” is a company, charity, public body, trader or person buying for business purposes, including gifts for employees or managers. A “Personalised Order” includes engraving, printing, branding, dedication, bespoke packaging, special content selection or made-to-order production.

For a Business Customer, an approved written quotation, purchase order, specification or commercial agreement prevails on a matter it expressly covers. Consumer rules that apply only to Consumers will not apply to a business transaction to the extent permitted by law.

3. Eligibility and acceptable use

You must be at least 18 and legally capable of entering into a contract. You must provide complete, accurate and current information and must not impersonate another person, commit fraud, use an unauthorised payment method, interfere with the Site, attempt unauthorised access, scrape the Site systematically or infringe third-party rights.

We may hold, reject or cancel an order where we reasonably suspect fraud, unlawful activity, a material breach, a material error or a security risk, subject to applicable law and any required refund.

4. Product information and Site content

We take reasonable care to describe dimensions, materials, colours, origin, stock and product characteristics accurately. Colour, texture, packaging, edition and immaterial details may vary between screens, production batches and suppliers. Photographs, lifestyle images, mock-ups, gift arrangements and accessories are illustrative only unless expressly stated to be included.

Books currently offered in the Site’s book category are in Hebrew unless the product page expressly states otherwise. Editorial statements about a book’s usefulness or content are general information and do not promise a business, financial, professional or personal outcome.

Statements about country of manufacture, design or brand origin are based on manufacturer or supplier information reasonably available to us. If goods materially differ from their description, the customer’s statutory remedies apply.

5. Prices, VAT and currency

Prices are stated in New Israeli Shekels and include Israeli VAT where applicable, unless stated otherwise. Delivery, personalisation, branding and additional services are shown separately before checkout. The price in the order summary applies, subject to a good-faith correction of an obvious error.

Promotions and coupons are subject to their displayed terms, cannot be combined unless stated and have no cash value.

6. Orders, stock and contract formation

An automated “order received” message acknowledges receipt and is not necessarily final acceptance. An order is accepted after payment authorisation, stock verification and reasonable fraud checks.

Before dispatch, we may reject or cancel an order because of unavailable stock, supplier limits, a material pricing or description error, suspected fraud or a legal restriction. We will contact the customer and, as appropriate, offer an alternative, a wait for restocking, or cancellation with a full refund of the cancelled portion without penalty.

An order confirmation will be sent to the contact details supplied. The customer should promptly check the product, quantity, price and delivery address.

7. Payments and checkout security

Payment is taken when the order is placed, subject to payment authorisation and stock availability. Card processing is provided by MAX. Supported cards may include Visa, MasterCard, American Express and Diners, as displayed at checkout.

Payment may also be made through PayPal, Apple Pay and Google Pay where available for the customer’s device, browser, location and account. The payment methods actually available are those displayed at checkout at the time of purchase.

Payment data is submitted directly to the authorised payment provider. Nordhaus may receive a transaction token, last four digits, payment type and status, but does not store the full card number or security code. A payment provider may require additional authentication or decline a transaction under its own rules.

8. Delivery within Israel

The online store currently delivers to addresses within Israel only. The active delivery methods are:

Current delivery charges are shown before payment. At the date of this version, the charge is NIS 29.90 for pickup-point delivery and NIS 39.90 for home delivery. The delivery charge shown in the order summary at the time of purchase controls.

Delivery time is subject to Israel Post’s policies, availability and service schedule. We do not promise a fixed number of delivery days unless an express commitment appears on the product page or at checkout. Security conditions, force majeure, industrial action, weather, heavy demand, an incorrect address or carrier disruption may cause delay without limiting a non-waivable customer right.

The customer must provide an accurate address, city, postcode and telephone number and must be available for delivery or collect the parcel on time. Reasonable re-delivery costs caused by an incorrect address, absence or non-collection may be charged unless the failure is ours or law provides otherwise.

Risk passes only upon physical delivery to the customer or a person authorised by the customer where applicable law so requires. The parcel should be inspected promptly, and damage, shortage or incorrect goods should be reported without unreasonable delay, with photographs where practicable. Failure to report immediately does not remove a mandatory right.

International checkout and cross-border delivery are not currently enabled. A country will be opened only after the applicable delivery, tax, customs, product-safety, returns and privacy requirements have been completed.

9. Cancellation, returns and exchanges

An Israeli Consumer may cancel a distance sale within the periods and on the conditions set by the Israeli Consumer Protection Law, 1981 and its regulations. For goods, notice may generally be given from the transaction date until 14 days after receipt of the goods or the statutory disclosure document, whichever is later. Special statutory periods may apply to a senior citizen, new immigrant or person with a disability where the legal conditions are met.

Cancellation notice may be submitted through the cancellation page at nordhauscraft.com/cancellation/, by email to nordhauscraft@outlook.com, by telephone or WhatsApp at +972-55-556-8258, by registered post to the business address, or by any other method required by law. Include the customer’s name, order number, contact details and the item concerned.

For a permitted convenience cancellation not caused by defect, non-conformity, failure to deliver by an agreed date or our breach, we may charge no more than 5% of the transaction price or NIS 100, whichever is lower, where Israeli law allows. Return carriage is the customer’s responsibility.

No cancellation fee will be charged for defect, non-conformity, incorrect or missing goods, failure to deliver by an agreed date or our breach, and we will arrange or fund return where required by law.

Do not return goods before receiving return authorisation and instructions. The return address is 18/4 Eucalyptus St., Ofakim, Israel, or another address supplied by us in writing. Where possible, goods should be complete, unused and returned with accessories and packaging. Opening packaging alone does not remove a statutory cancellation right where law provides otherwise, but material deterioration may give us a lawful remedy.

Refunds are made to the original payment method within the legally required time. The payment provider or card issuer may require additional processing time before the credit appears. An exchange is subject to stock and customer choice and does not replace a statutory refund right.

Exceptions to cancellation, including goods made specifically to a customer’s measurements or requirements or goods that have been engraved or personally branded, apply only to the extent and on the conditions permitted by law. Defect and non-conformity rights remain unaffected.

10. Defects, warranties and support

Defective, incorrect or incomplete goods are handled under applicable law and any product warranty. Contact us with the order number and a description of the issue. We may request photographs or a reasonable inspection and will offer repair, replacement, completion or refund as appropriate.

Warranty periods and conditions for watches, writing instruments, leather goods and other products appear on the product page or warranty certificate. A manufacturer’s or importer’s warranty does not reduce Nordhaus’s statutory obligations. Fair wear, use contrary to instructions, accidental damage, exposure to water beyond a product’s rating or unauthorised repair are not original defects unless law provides otherwise.

11. Corporate gifts and Personalised Orders

A business quotation remains valid for its stated period and is subject to stock, supplier availability and exchange rates. Work on a Personalised Order begins only after written approval of the specification, proof or mock-up, price and schedule, and payment of any required deposit.

The customer must approve spelling, names, logos, colours, quantities and placement. After proof approval, Nordhaus is not responsible for an error present in the approved material, except a production error that departs from it. Reasonable, immaterial process variations in colour, texture, placement or size are not necessarily non-conformity.

The customer confirms that it has the right to use every logo, text or file supplied. Cancellation after proof approval, bespoke procurement or production has begun may require payment of costs incurred where contract and law permit. Defect and non-conformity rights remain unaffected.

12. Reviews and user content

Reviews must be relevant, honest and based on personal experience. Do not submit knowingly false, abusive, threatening, infringing, promotional, spam, irrelevant content or another person’s personal data. Reviews may be moderated before publication but will not be removed merely because they are negative.

If a discount or other incentive is offered for a review, it will be clearly disclosed alongside the review. The Site does not automatically publish customer images; an image supplied to us will be published only after review and express permission.

13. Intellectual property

The Site, design, logo, editorial copy, images, code and materials are owned by or licensed to Nordhaus. They may not be copied, altered, distributed, scraped, used to create derivative works or used commercially without prior permission, except for reasonable personal use or use permitted by law.

Supplier, publisher and manufacturer marks, images and descriptions remain their owners’ property. Mention of a brand does not imply ownership or a partnership beyond what is expressly stated.

14. Third-party services

The Site is operated through iStores and may use third-party payment, delivery, invoicing, analytics and other services. Their own terms and privacy policies may also apply. This does not reduce Nordhaus’s legal responsibility to the customer.

15. Privacy and data security

Personal data is handled under the Site’s Privacy Policy, which forms part of these Terms. Acceptance of these Terms is not, by itself, consent to direct marketing or non-essential cookies where separate consent is required.

16. Disclaimers and limitation of liability

The Site is provided as available. We take reasonable care but do not promise uninterrupted or error-free operation. Editorial recommendations and value statements are not legal, medical, investment or other professional advice and do not guarantee results.

To the fullest extent permitted by law, Nordhaus is not liable for indirect, special or consequential loss that was not reasonably foreseeable when the contract was made. Where a cap is lawful, aggregate liability connected with an order is limited to the amount paid for it. This does not apply to mandatory consumer rights, personal injury, fraud, wilful misconduct, gross negligence or liability that cannot lawfully be limited.

17. Force majeure

A delay caused by an event outside our reasonable control, including war, security emergency, natural disaster, epidemic, widespread strike, infrastructure failure, government restriction or disruption affecting an essential supplier, is not a breach to the extent permitted by law. We will take reasonable steps to mitigate and update the customer. Non-waivable cancellation and refund rights remain unaffected.

18. Changes to these Terms

We may update these Terms for changes in law, services or operations. The current version and update date will be posted on the Site. A material change does not retroactively change an accepted order unless required by law or favourable to the customer.

19. Governing law, jurisdiction and language

Israeli law governs these Terms and transactions made through the Site. Competent Israeli courts have jurisdiction, subject to a Consumer’s mandatory right to apply to another competent court, authority or forum.

The Hebrew version controls transactions in Israel. This English version is provided for convenience; if there is a conflict, the Hebrew version prevails to the extent permitted by applicable law.
